KBK Obtains Public Injunction Against Sewer Service Debt Collectors

On October 4, 2023, KBK, working as co-counsel with Bay Area Legal Aid (BayLegal) and Bramson, Plutzik, Mahler & Birkhaeuser, LLP, obtained a statewide injunction in Alameda Superior Court against Achievable Solutions, Inc. (ASI), its principal Takashi Cheng, and associated business SueYa, Inc. The Alameda Superior Court issued the injunction, which bars the enforcement, transfer, or collection of numerous disputed collection accounts and judgments that allegedly were obtained by sewer service. ASI and SueYa admitted to the practice of “robo-signing,” affixing pre-existing signatures to sworn declarations without proper review.

BayLegal brought this lawsuit to remedy the impact of fraudulently obtained default collection judgments on low-income consumers. The sweeping injunction highlights issues with high-volume debt collection lawsuits, which are currently overwhelming California courts.
