KBK Defeats Enerbank Motion To Compel Arbitration

On May 5, 2026, the United States District Court for the Eastern District of California denied Defendant Enerbank’s Motion to Compel Arbitration.

The case involves a scheme in which Plaintiff alleges that Enerbank partnered with a door-to-door sales team to forge Plaintiff’s signature on a multi-decade financing agreement for solar panels.

Enerbank attempted to compel arbitration. The Court denied Enerbank’s motion. The Court held that Plaintiff’s contract was voidable due to violations of the Home Solicitation Sales Act.
